  1. Applicability

1.1 The following conditions form the basis of a contract for booking services between Châteaux Travels (“Travel Agency,” “we,” “our” and/or “us”) (“we” and “our” and “us”) and the first named company or person on the booking and all persons on whose behalf a booking is made or any other person to whom a booking is added or transferred (’you’ and ‘your’) via our Website Châteaux Travels (the “Website”).

By booking, registering for, making a payment towards, or participating in a tour or other travel product or service with us, you agree to the terms that apply to that booking package in effect at the time of your booking.

  1. Your Information

2.1 To facilitate your booking and enhance our ability to provide the purchased travel products and services, we mandate specific personal information as required by law or reasonably necessary. This includes, for each traveller, the:

(a) complete legal name,

(b) gender,

(c) birthdate, and

(d) Passport information

In addition, you are also required to provide contact information, such as address, phone number, email address and emergency contact details. 

2.2 It is your responsibility to verify the completeness and accuracy of the information provided for yourself and other travellers on your booking. We shall not be liable for any errors or omissions in the information you provide, and any associated fees or damages are not our responsibility.

2.3 Travellers with disabilities or  requiring any type of special assistance must notify us of their requirements at the time of booking. We will make reasonable attempts to accommodate such special needs, however, we cannot guarantee that all disabilities or difficulties can be accommodated.

  1. Booking, Payment, and Confirmation

3.1 Booking

(i) You may book a tour through Website. All bookings are subject to availability.

(ii) Any bookings and reservations undertaken by third parties directly via a booking link from this Website shall be subject to such third party’s respective booking conditions.

3.2 Booking Confirmation

(i) Bookings are confirmed upon receipt of payment. We reserve the right to cancel bookings if payments are not received within the specified time.

(ii) Booking confirmations will be sent via email upon successful payment. It is your responsibility to provide a valid email address for communication.

(iii) By making a booking, you agree on behalf of themselves and all persons detailed on the booking that:

  • he/she has read these Terms and Conditions and has the authority to and does agree to be bound by them;
  • he/she consents to our use of personal data in accordance with our Privacy Policy and is authorized on behalf of all persons named on the booking to disclose their personal details to us, including where applicable special categories of data (such as information on health conditions or disabilities and dietary requirements);

(c) Pricing:

Tour prices are clearly stated on our Website. We reserve the right to change prices offered on our Website at any time but this will not affect the price of any bookings that have already been confirmed.

(d) Payment Methods:

Accepted payment methods include credit/debit cards and other methods as specified on our Website. Payment must be made in full at the time of booking.

(e) Services from Independent Suppliers

Many of the services which make up your tour are provided by independent suppliers. Those suppliers provide these services in accordance with their own terms and conditions. Some of these terms and conditions may limit or exclude the supplier’s liability to you.

Product information posted on our Website is based on information collected from the suppliers. Reasonable care has been taken that the content of our Website is correct but it is subject to amendment at any time without notice. All content on this Website is published in good faith but you acknowledge that we, as booking agent, cannot check the accuracy of all information provided by its suppliers.

  1. Your Responsibilities

4.1 You are responsible for ensuring you possess valid passports, visas, and comply with entry requirements of the booked tour(s). We will not be not responsible for any consequences resulting from inadequate travel documents.

4.2 You are advised to  take out adequate and suitable travel insurance in order to take part in a tour organised by us. You are wholly responsible for arranging your own insurance.

  1. Cancellation of Booking by You

You may request cancellations to confirmed bookings, subject to the following terms and conditions:

5.1 Official Cancellation Period

We provide an official cancellation period for each booking, as specified in the confirmation email. This period may vary depending on the type of tour booked.

5.2 Online Cancellation Process

If you have booked online through our Website, a “cancel and refund” link will be provided in your confirmation email. To initiate cancellation and an automated refund, simply click this link and follow the provided steps.

5.3 Refund Process

Upon successful cancellation, a full refund will be automatically and securely processed to the card used for the booking. Please allow 10-15 business days for the refund to appear on your account.

5.4 Confirmation of Cancellation

An automatic email confirmation of the cancellation and refund will be sent immediately upon the successful completion of the cancellation process. 

5.5 Late Cancellations

If you choose to cancel after the cutoff time governing the booked tour, no refund will be granted. Similarly, no refund or partial refund will be made once a tour has commenced or for any utilized tour package, accommodation, meals, or other services.

5.6 Cancellations or Amendments with Independent Suppliers

If you directly cancel or amend services with a supplier contracted through our Website, the specifications of the contract between you and the supplier shall apply. 

  1. Cancellation of Booking by Us

6.1 The majority of our advertised packages necessitate a minimum number of travellers to proceed. We retain the right to cancel or reschedule any departure due to insufficient demand, unsafe conditions, unforeseen events, or any other reason. In the event of a departure cancellation, we will notify you before the final payment due date (unless the cancellation results from an unforeseen situation arising after that date) and present alternative travel dates or a complete refund. Additionally, we reserve the right to cancel a specific booking or remove a particular traveler at our discretion before departure and will refund all funds paid to us

We are not liable for any incidental expenses or consequential losses you may incur as a result of a canceled booking. This includes, but is not limited to, loss of earnings, loss of enjoyment, or the costs associated with connecting flights, accommodations, airport transportation, visas, document fees, vaccinations, or other services dependent on the operation of your trip.

9.1 We collaborate with various independent entities, including local guides, activity providers, and other independent parties (“Independent Suppliers”) to furnish components of your booking. Independent Suppliers may, in turn, engage local operators and sub-contractors. While we exercise careful selection of Independent Suppliers, we do not supervise or control these entities and cannot be held accountable for their acts or omissions.

9.2 In the absence of our own negligence, we disclaim responsibility for any cancellations, delays, diversions, or substitution of equipment; loss or damage to baggage or property; injury, illness, or death; or any claims, losses, damages, costs, or expenses arising out of inconvenience, loss of enjoyment, upset, disappointment, distress, or frustration, whether physical or mental. Such events may result from any act, omission, error, or negligence by any company, or any other individuals providing services to you, who are not our direct employees or under our exclusive control. We disclaim responsibility for any criminal conduct by third parties.

  1. Acceptance of Risk

10.1 You acknowledge that the tour(s) may  involve some risk to your health and safety. The degree and nature of personal risk involved depends on the products or services booked and the location(s) in which a product or service operates. 

10.2 We cannot be held responsible for the actions or behaviour of other guests or individuals who have no connection with your booking arrangements or with us.

10.3 By booking with us, you acknowledge that you have considered the potential risks, dangers and challenges, and your own personal capabilities and needs, and you assume responsibility for all such risks. You agree to take all prudent measures in relation to your own safety while traveling, including but not limited to the proper use of safety devices and obeying all posted signs and oral or written warnings regarding health and safety. We and our representatives will not be held liable for any claims or causes of action arising from any losses, damages, injuries, or death resulting from failure to comply with safety instructions or warnings or the risks inherent in travel and participating in adventurous activities included in our itineraries or otherwise offered by us or our representatives.

10.4 Should any medical emergency arise which precludes your ability to consent to emergency treatment when such authorization is required, we or our representatives will endeavor to communicate with your travel companions or previously designated emergency contact to request permission for any necessary treatment. If our representatives believe, at their sole discretion, that time or circumstances do not permit such communication, you authorize our representatives to consent on your behalf to any medical treatment, including all types of medical examinations, diagnoses, medication, treatment, or physician or hospital care, that is deemed advisable by, and is to be rendered under, the supervision of any physician or surgeon. You agree not to hold us or our representatives responsible for actions relating to any such medical or emergency treatment.

  1. Limitation of Liability

In no circumstances shall we be liable for any consequential and indirect loss or damage. Our liability is limited to the amount paid to us for any booking. This limitation, however, does not apply to our liability for death or personal injury caused by our negligence.

  1. Complaints

12.1 Any complaints must be reported promptly to us during the tour to allow for resolution.

12.2 Any complaints arising out of any arrangements must be reported to the relevant local supplier

  1. Force Majeure

13.1 We shall not be liable for any failure or delay in the performance of our obligations, directly or indirectly resulting from any cause or circumstance beyond our reasonable control. Such circumstances include but are not limited to acts of God, outbreak of hostilities, riots, civil disturbances, acts of terrorism, revolution, actions of any government or authority, fire, flood, epidemic, lightning, explosion, fog or bad weather, interruption or failure of utility services, renovations by the hotel, strikes, lockouts, or boycotts, embargo, blockade.

  1. Miscellaneous

14.1 If any provision of these Terms is deemed unenforceable, such provision will be interpreted to be enforceable only to the extent permitted by law. The invalidity or unenforceability of any provision will not affect the validity or enforceability of the remaining provisions.

14.2 We reserve the right to update or modify these Terms at any time. Amendments will be posted on our Website at [insert Website link], and they will take effect immediately upon posting.

  1. Governing Law:

 

This document is governed by and are to be construed in accordance with English Law.

All disputes controversy, difference or claim arising out of or in connection with this document, including any question regarding its existence, validity or termination, or any dispute regarding non-contractual obligations shall be finally settled under the arbitration rules of the London Court of International Arbitration by one or more arbitrators appointed in accordance with the said rules. The seat of Arbitration shall be London and proceedings shall be conducted in English.
